PROJECT PROMOTES THE RIGHTS OF PERSONS WITH DISABILITIES

 

People with disabilities are one of the most sensitive and specific elements of socio-developmental, economic and, above all, social policy in general. The project aims at the development of disability protection within the framework of modern, pluralistic social policy.

IMPROVE SOCIAL INCLUSION AND EMPLOYMENT OF PERSONS WITH DISABILITIES THROUGH EFFECTIVE POLICIES

 

In view of the person with disability as an individual, one person with all the general and specific requirements, system solutions must each group of persons with disabilities to enable to form, express and realize their basic development needs. As special interests have the same opportunities as non-disabled people, and above all to have the right to be different.

Today, the situation of persons with disabilities must be seen primarily as a human rights issue. Disability is a complex social phenomenon which practically touches on all areas of modern life and requires inter-sectoral coordination and partnership, the development of entrepreneurial skills and knowledge, self-employment and job creation, shared her various authorities, local governments, civil society and persons with disabilities themselves and their organizations. Emphasis is placed on guaranteeing the equality of persons with disabilities, non-discrimination and their full participation.

RIGHTS OF PERSONS WITH DISABILITIES

 

Definition of Disability usklađenaje with the Convention on the Rights of Persons with Disabilities of the United Nations, of which the Republic of Serbia has signed (2009). It is based on the social model, and understanding of disability from the context of human rights. The Law on Vocational Rehabilitation and Employment of Persons with Disabilities defines a person with a disability as a person with permanent visits and / or sensory, mental, mental or mental disorders or diseases that can not be eliminated by treatment or medical rehabilitation, which faces social and other limitations from the impact on work ability and the ability to work or maintain employment. A person who does not have the capacity or has a reduced ability to participate, on equal terms, on the labor market and apply for employment with other persons.

QUESTIONS AND PRESIDENCIES

 

Persons with disabilities represent one of the categories of persons with barriers to employment, due to problems such as:

 

  • Health restrictions (reduced working capacity)
  • Low self-esteem
  • Prejudices by employers according to their working abilities
  • Inadequate education, lack of education or work experience
  • Difficulties in adaptation (working environment, society)
  • Low level of social support

What job can a person with disabilities do?

 

While disability, on the one hand, imposes restrictions, on the other hand and persons with disabilities can acquire, develop and enrich their knowledge, skills and talents with formal and non-formal channels through education, hobbies and personal interests. In this respect, people with disabilities do not differ from persons with disabilities.

An employer can employ a person with disabilities in two ways:

 

  1. Under general conditions – without adjustment
  2. Under special conditions – with adjustment

In the context of the adjustment, professional assistance can be provided as support for introduction to the job, or in the workplace through counseling, training, assistance services and workplace support, work monitoring, development of personal methods of work and assessment of efficiency

EMPLOYMENT OF PERSONS WITH DISABILITIES

 

An employer who employs a person with a disability who needs professional support at the workplace can exercise the right to reimburse the cost of earning a person engaged in providing professional support to a newly employed person with disabilities only during the time of providing professional assistance for a maximum of 12 months.

An employer who employs a person with a disability who needs a workplace adjustment may exercise the right to refund appropriate workplace adjustment costs in a one-time amount, whereby the adequacy is aligned with the assessment of working ability. Adjustment of the workplace implies the technical and technological equipping of the workplace, means of work, space and equipment in accordance with the possibilities and needs for persons with disabilities. The refund of the eligible costs for adjusting the work of the seats can be granted to the employer, in a single amount, up to 400.000,00 dinars per person with disability. An employer who permanently employs a disabled person without work experience shall be entitled to a subsidy for work for that person, for a period of 12 months from the date of the establishment of the employment relationship with the person with disabilities. Wage subsidy is granted on the basis of the submitted employer’s request, up to 75% of the total wage costs, with the compulsory social security contributions, but not more than the minimum amount for work determined in accordance with labor regulations.

Article 45b of the Law on Contributions for Compulsory Social Insurance allows an employer who permanently employs a person with disability to release the obligation to pay contributions for compulsory social security payable on the basis or at the expense of the employer’s funds for a period of 3 years, from the date of the employment of that person.

A subsidy for the employment of unemployed persons in the category of hard-to-employ in new jobs is granted to employers who belong to the private sector, in a one-off amount, work and for sending unemployed people who are kept on the records of the National Employment Service. Weight category for senders to which this subsidy includes people with disabilities. The amount of the subsidy depends on the level of development of the local self-government unit (hereinafter: JLS) according to the place of employment of the person, in accordance with the valid regulation of the Government of the Republic of Serbia.

Funds granted on the basis of subsidies for the employment of unemployed persons in the category of hard-to-employ people in newly opened jobs, where minimum state aid is available (state aid of small value). The employer who has exercised the right to a subsidy for job creation, among other things, is obliged to establish a full-time employment relationship with unemployed persons for which he is entitled to a subsidy, whereby the National Service monitors the realization of the contractual obligation 12 months. The public invitation is usually opened every year on the day of publication until the expense of the available funds allocated for this purpose, and no later than the last calendar day of the year. 300,000.00 dinars per person, in the fourth group of JLS and devastated areas.

 

LEGAL OBLIGATION OF EMPLOYMENT OF PERSONS WITH DISABILITIES

 

This obligation is prescribed with an appropriate scale based on the total number of employees, including persons with disabilities. This obligation applies to any company with 20 or more employees.

The total number of employees includes all persons who are in employment in accordance with the regulations on labor and as such have been registered with the competent organizations of mandatory social insurance. This means that persons who have been employed for indefinite and part-time work are included, while persons with part-time work are also taken into account, as well as those who perform jobs outside the employer’s premises.

 

OBLIGATION OF EMPLOYMENT OF PERSONS WITH DISABILITIES

 

1 – 19 employees – 0

20 – 49 employees – 1

50 – 99 employees – 2

100 – 149 employees – 3

 

For each of the following, 50 employees per one disabled person.

The total number of employees includes all persons who are employed in accordance with labor regulations and such are reported to the competent organizations of compulsory social security. This means that persons who have been employed for an indefinite period of time have been employed, taking into account the non-part-time work, as well as those who perform jobs outside the employer’s premises.

 

WHY YOU EMPLOYE THE PERSON WITH DISABILITIES

 

People with disabilities are a rich and often forgotten source of human resources in almost all professions. Experiences of employers who employ people with disabilities evaluate workers with disabilities as average or above average in performing tasks, regularity of entry to work and compliance with safety and health rules at work. Also, people with disabilities can often be more loyal to employers who hire them. Apart from the fact that people with disabilities can contribute to the success of their businesses with their skills and valuable work, companies can praise the diversity of workforce that reflects the diversity of society. This can in particular be opened by more new customers and customers and consumers, for which the company does not pay special attention.

Corporate culture and socially responsible business are in modern concepts that the company turns to play a positive image of itself in the eyes of investors, customers or future clients. Adoption of policies that reflects the maintenance of any discrimination, respect for the needs and interests of employees, and awareness of the impact of the company on society are not related to the size of the company. Thus, all those who adopt and apply them can also boast of their active contribution to the development of a humane society. Employment of a person with disabilities can bring the company innovativeness in the organization and implementation of activities, as well as finding alternative solutions.
